Family violence includes emotional and psychological abuse, intimidation, harassment,
stalking, physical and sexual assault and damaging personal adjoined property.
If a party is faced with this situation they can apply to the Courts for an Apprehended
Domestic Violence Order (ADVO). It can also include an Order that
the person not be allowed to return home.
If the person breaches the Order it becomes a criminal offence.
The Family Court of Australia adopted the “family violence best practice principles”
which ensures that the Court will explicitly consider the Orders when they determine
what’s in a child’s best interest.
